Presented by Anthony Quahe, Managing Principal Civic Legal, (see bio) this 2 day course as been specifically designed for professional, technical and supervisory staff working in public works, both private sector and government agencies who work with and need to understand all aspects of the legalities contracts.

The course will be broken down into 4 parts covering:

Contract Law and the Procurement Process This course explores the key legal aspects of contract law and how they apply to the procurement process. It will cover the law on how contracts are formed and the application of that knowledge to the making of contracts both generally and in a public tender process.

Participants will gain a greater awareness of the law surrounding the tendering of contracts and become better equipped to ensure their processes comply with relevant laws.

Pre-contractual Legal Risk Management This course focuses on how to minimise legal risk before the contract begins – whilst writing specifications and drafting contracts. Participants will gain a working appreciation of some key legal implications arising from the way specifications are written. The course will also explore the uses of some common contractual clauses and teach risk management strategies that can be used in drafting contracts.

It will give participants an understanding of some of the methodology applied by lawyers, and equip them to improve their own approaches to creating specifications and contracts or, at the very least, identify some of the legal risks associated with this area.

Contract Management This course builds on the material presented the previous day and focuses on managing contracts once they have begun. It covers basic contract law rules on monitoring performance, managing claims for variation, breach of contract and termination. Participants will learn strategies to help identify and avoid legal risks where projects do not quite go according to plan, and gain skills to enable them to manage contracts more effectively.

Enforcement of Legislation This course explores some legal aspects of enforcing legislation. Participants will gain an understanding of legal matters that can have a significant bearing on whether an administrative act of enforcement or court prosecution will be successful.

The topics to be covered will include the gathering of evidence, powers of entry, service of notice, documentation of delegations and decision making as well as administrative fairness. The material will be relevant to the enforcement of laws such as those relating to town planning, health, environment and building legislation, as well as the Local Government Act.

Participants will become better equipped to conduct enforcement action effectively.

This event will be held in a face to face format.
